Acceptable Use Policy

1. Purpose
This Acceptable Use Policy (“AUP”) describes the standards of conduct expected from anyone who uses the website, services, software, or deliverables provided by Nxbit01 LLC(“Nxbit01,” “we,” or “us”). It applies to website visitors, prospective clients, active clients, and any person who accesses or uses our work product.
2. Prohibited Uses
You may not use our website, services, or any deliverables we provide to:
Illegal or harmful activity
- Violate any applicable local, state, national, or international law or regulation.
- Engage in fraud, identity theft, or deceptive practices.
- Transmit or store material that infringes on intellectual property rights.
- Facilitate harassment, stalking, or threats of violence.
Security violations
- Attempt to gain unauthorized access to any computer system, network, or data.
- Introduce malware, viruses, ransomware, spyware, or any other malicious code.
- Conduct unauthorized penetration testing, port scanning, or vulnerability enumeration against systems belonging to others.
- Intercept or monitor communications without authorization.
Abuse of services or deliverables
- Reverse-engineer, decompile, or disassemble software we provide in a manner not permitted by the applicable service agreement or license.
- Resell, sublicense, or transfer our work product to third parties without written consent.
- Use automation flows, apps, or integrations we build for purposes materially different from those agreed upon in your engagement scope.
- Use any deliverable to scrape, harvest, or misuse third-party platform data in violation of those platforms' terms of service (including Microsoft, Azure, SharePoint, or Teams APIs).
Misrepresentation
- Misrepresent your identity, organizational affiliation, or authority to enter into a service agreement.
- Provide false information in any form submission or during a service engagement.
- Impersonate Nxbit01 LLC or any of its personnel in any communication.
3. Microsoft Platform Compliance
A significant portion of our work involves Microsoft Azure, Power Platform, Microsoft 365, and related services. All solutions we build are designed to operate within Microsoft's published acceptable use policies and platform terms of service. Clients are responsible for ensuring that their use of solutions we build remains compliant with:
- Microsoft Online Services Terms and Data Protection Addendum
- Microsoft Azure Acceptable Use Policy
- Power Platform licensing and capacity terms
- Microsoft Graph API terms of use
If you become aware that a solution we built is being used in violation of these terms, you are responsible for remedying that use and notifying us promptly.
4. Data Handling by Clients
When Nxbit01 LLC builds data pipelines, reporting solutions, or integrations that process your organizational data, clients are responsible for ensuring that such data is handled in compliance with all applicable privacy laws and regulations (including GDPR, CCPA, HIPAA, or other applicable frameworks) and any data handling obligations imposed by their own policies or contracts with third parties.
Nxbit01 LLC is not responsible for how clients use or misuse data processed by solutions we build after delivery and acceptance.
5. Reporting Violations
If you believe that someone is using our website or a solution we built in violation of this AUP, please contact us at hello@nxbit01.com. We will investigate and take appropriate action.
6. Consequences of Violations
Violation of this AUP may result in:
- Immediate termination of your engagement or service agreement.
- Removal of access to any deliverables, environments, or resources we control.
- Notification to relevant authorities where required by law.
- Legal action to recover damages caused by the violation.
7. Changes to This Policy
We may update this AUP at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised AUP. For active client engagements, material changes will be communicated directly.
